What are the penalties in Indiana for a misdemeanor or felony offense?


PENALTIES FOR MISDEMEANOR OFFENSES IN INDIANA

  • Class C Misdemeanor:  Up to 60 days in jail.  Maximum fine of $500.  
  • Class B Misdemeanor: Up to 180 days in jail.  Maximum fine of $1,000.
  • Class A Misdemeanor: Up to 365 days in jail.  Maximum fine of $5,000.

PENALTIES FOR FELONY OFFENSES IN INDIANA

  • Level 6 Felony: 6 months to 2.5 years in jail/prison. Maximum fine of $10,000. 
  • Level 5 Felony:  1 to 6 years in prison.  Maximum fine of $10,000. 
  • Level 4 Felony: 2 to 12 years in prison.  Maximum fine of $10,000. 
  • Level 3 Felony: 3 to 16 years in prison.  Maximum fine of $10,000. 
  • Level 2 Felony: 10 to 30 years in prison.  Maximum fine of  $10,000. 
  • Level 1 Felony: 20 to 40 years in prison.  Maximum fine of $10,000.
  • Murder: 45 to 65 years in prison.  Maximum fine of $10,000.

The prosecuting attorney may seek sentencing enhancements/additional term of imprisonment for:

Use or possession of firearm;

Criminal gang;

Repeat sex offender;

Habitual offender;

Causing termination of human pregnancy;

Felony terrorist offense;
