Operating While Intoxicated Offenses
Class C Misdemeanor (0 to 60 days in jail)
Operating a Vehicle with .08% g/alc. Or greater.
Operating a Vehicle with controlled substance listed in schedule I or II of IC 35-48-2 or its metabolite in the person’s blood
Operating a Vehicle While Intoxicated.
Class A Misdemeanor (0 to 365 days in jail)
Operating a Vehicle with .15% g/alc. Or greater.
Operating While Intoxicated in a Manner that Endangers a Person
Level 6 Felony (6 months to 2.5 years in jail)
OWI, with a prior conviction within the past 7 years
OWI (if person at least 21 years of age) with a passenger under 18 years of age
OWI causing death of a law enforcement animal
Level 5 Felony (1 to 5 years in prison)
If person commits OWI Level 6 Felony with a prior conviction for OWI causing death/catastrophic injury or serious bodily injury.
Level 4 Felony (2 to 12 years in prison)
OWI causing death or catastrophic injury.
